On November 9, around 8 p.m., a man was hit in the arm by gunfire while he was trying, armed and hooded, to commit a burglary in a house in Montfaucon in the Gard. It was the owner of the premises who fired the shots.
As our colleagues at Midi Libre point out, the burglar was found by the police, seriously injured in the arm. Aged 51, he was taken care of by the firefighters and he is still hospitalized this Monday, November 11.
The man who opened fire, the farmer who owned the house into which the thief broke in, had been taken into custody for armed violence.

This Monday, the Nîmes prosecutor, Cécile Gensac, indicated in a press release that he was released without being prosecuted. It specifies that “the conditions for self-defense as provided for by the Penal Code” are met. She justifies her decision by explaining that it follows the first investigations carried out quickly in order to determine the exact course of the facts via the hearings of the victims, witnesses, and the accused, but also several technical investigations.

As for the injured man, who will be heard when his state of health allows, he is already known to the courts for drug offenses, theft and road traffic offenses. He is now charged with attempted aggravated robbery. According to the prosecutor, “investigations will continue into the facts and the charge of attempted robbery with a weapon and by an organized gang, with a view to questioning the man arrested and identifying any other person involved.”
