“She had the courage to go to the police and lie about accusing me of raping her, but not to come before your court. » The victim, a Royan resident in his early forties, confided his distress to the Saintes judicial court on Thursday, November 7, which was judging a case of slanderous denunciation.
In May 2023, in Royan, he found himself accused of rape by a woman, now aged 21, with whom he had had a “complete and non-consensual” sexual relationship, according to her. Except that everything she denounces is entirely false. Why did you act like this? It all starts with an intimate video where we see the young woman performing oral sex on her lover.
Fake tears, real lie
The gentleman's companion, suspicious, searches his phone and comes across this very explicit video. She sends it to the young woman's companion. Out of fear, the latter preferred to lie so that the only truth would not be revealed to her official boyfriend. So here she is at the Royan police station to file a complaint. “She will start crying as soon as she talks about the facts,” describes Olivier Lalande, the president of the correctional hearing.
Her lover finds himself interviewed by the Royan police officers. “When I entered the police station, I will always remember the looks of contempt and judgment from the police,” says the victim, who has already had dealings with the law in the past. That was the hardest part. Royan is a small town, everything is known. »
Disturbed victim
Fortunately, he quickly managed to provide proof that the sexual relationship was consensual. “If I hadn't been able to prove it, I would certainly be in prison for something I didn't do…” he says, disillusioned. His lawyer, Me Zerbib, remade the film of this story, emphasizing the moral and material damage for his client. “This affair has greatly disturbed him, even in his work,” supports the Parisian council.
He requests that the defendant be ordered to pay the victim 3,000 euros for moral damage, 1,620 euros for material damage as well as €1,855.32 for legal costs. The court will grant it. Found guilty, the big absentee of the day also received three months in prison.
