A couple from Bellevigny, in Vendée, asked, Thursday May 16, 2024at the administrative court of Nantes,cancel the building permit which was granted on March 8, 2023 by Mayor Philippe Briaud to Vendée Logement ESH to bring out of the ground “35 social housing units” and “two activity units” at numbers 5 and 7 rue du Stade.

Benjamin and Léa, whose property “adjoins the project plots”, believe that the project does not “fit” into the landscape and that there is a lack of parking spaces.

They are also demanding €3,000 to cover their legal costs.

Neighbors’ sunshine respected

Certainly, the building would not be “not at the same height” than the neighboring houses: the project is established on three levels while the houses in the neighborhood are “mainly on one level”, but “this is not enough to determine its poor integration” into the landscape. And the project also respects the “sunshine” of neighboring owners, according to the magistrate.

Vendée Logement ESH also has respected the minimum number of parking spaces to be provided for his project, from his point of view:

Seven parking spaces, including one for people with reduced mobility (PRM) at the bottom of the building and twenty-eight additional spaces opposite, on the rue de la Poste side.

An opinion that the applicants’ lawyer does not share: lThe difference in level between the building and neighboring houses is “absolutely not authorized” by the local town planning rules of Bellevigny.
