What rules for a flea market?

Maximum two unboxing sales per year

As an individual not registered in the Trade and Companies Register (RCS), you cannot participate in more than two unboxing sales per year.

Registration in a register

For each unpacking sale, you must enter in the event seller identification register And attest on honor that you have not participated in more than two sales during the year. This register is first recorded and initialed by a police service, gendarmerie or by the mayor.

Sale of personal and used items exclusively

Article L310-2 of the Commercial Code specifies that individuals can only sell “exclusively personal and used objects”.

So, if you create objects yourself, you won’t be able to sell them in a flea market, garage sale or clearance sale without having declared yourself as a professional (for example, under the micro-enterprise regime).

In this case, you will have to pay the taxes and social charges that correspond to your plan.

Income from sales made by individuals during an unpacking sale is not to be declared to the tax administration and is therefore not not taxable.

There are only two cases in which income from sales must still be declared to the tax authorities:

  • if the goods sold are precious metals,
  • if you sell a property for more than €5,000 (excluding furniture, household appliances or automobiles which are exempt).
