In the wake of the fatal hit-and-run that occurred on Highway 15 on Thursday in Laval, host Luc Ferrandez welcomes Mr. Marc Bellemare to talk about the distinction between traffic violations and criminal offenses.

As a supporting example, Me Bellemare highlights a tragic case that occurred on January 3, 2022 where no criminal charges were ultimately brought.

“The judge finally considered that the statements which had been made by the driver were not admissible, because the police officer had led people to believe that this statement would not be followed up, that it was simply in the context of ‘a coroner’s inquest.’

“It is certain that in a criminal procedure, the slightest defect, the slightest deficiency, the slightest suspicious behavior on the part of the police officer can result in the rejection of a statement and, consequently, the cancellation of any possibility of criminal charges. .”

The latter criticizes the rigor of police and judicial procedures which, according to him, excessively protect the rights of the accused to the detriment of the victims, citing the Jordan decision of 2016 and the Federal Charter of 1982.
