The case involving journalist Cheikh Yérim Seck, Xavier Pryen, General Director of Éditions Harmattan, and ex-captain Seydina Oumar Touré reached its conclusion this Wednesday, May 8, with the verdict of the Dakar criminal court.

After having ruled publicly, contradictorily with regard to the civil party[…] the judge convicted Xavier Pryen, head of Éditions l’Harmattan, and the former journalist from Jeune Afrique, respectively of defamation and complicity of this leader.

The judgment of November 8, 2023 (no. 521/2023) was pronounced publicly, where Xavier PRYEN and Cheikh Yérim SECK were respectively found guilty and complicit in defamation. The defendants were sentenced to a six-month suspended prison sentence. The court also favorably received the civil party constitution of Seydina Oumar TOURE, who was awarded compensation of 5,000,000 FCFA as damages for losses.

The decision also ruled on the civil liability of Éditions l’Harmattan, the publisher of the book containing the defamatory remarks. They are declared civilly responsible and must guarantee payment of the amount owed to Seydina Oumar TOURE.

The court ordered the publication of this decision in three national dailies, Walfadjri, L’Observateur and Le Soleil, at the expense of the defendants. In addition, they are ordered to pay costs and the physical restraint was set at the maximum in accordance with article 460 of the Code of Criminal Procedure.

The former captain of the gendarmerie, assisted by his lawyer Me Moussa Sarr, won his case against the author of the book entitled “ Macky Sall faces history “. Indeed, Cheikh Yérim Seck had made accusations against Mr. Touré in his work.

In his book, “ Macky Sall faces history “, as a reminder, Cheikh Yérim Seck wrote about Seydina Oumar Touré elements likely to implicate him. He notably mentioned that Seydina Oumar Touré would have transmitted Adji Sarr’s complaint to Ousmane Sonko via WhatsApp, and would have encouraged Adji Sarr to hire a lawyer who would have obtained information on the complaint.
