Violence among young people: a phenomenon that is increasingly worrying

Christian Estrosi, Horizons mayor of Nice, announced it last week, and he was quick to implement it. On Wednesday May 1, the curfew for those under 13 from 11 p.m. to 6 a.m. came into force in his city. It will apply “during the summer period and at all gathering points”, said the councilor in a press release. Several districts are affected by the measure (Las Planas, Ariane, Bon Voyage, Saint-Roch, etc.) but also the Old Nice city center, where “the accusation of minors in acts of delinquency as victims or perpetrators is not weakening” in 2024.

The curfew is even stricter in the Moulins district, with the application of obligations not for those under 13, but for those under 16. According to the mayor’s words, in a document that TF1info was able to consult, the Moulins district is “in the grip of endemic drug trafficking (…) with minors often recruited by adults as lookouts or sellers”. To further justify this specific case, the councilor also recalls that of the 1000 arrested in this district in connection with this drug trafficking, 52% are minors.

Article 2 of the decree indicates that“in case of necessity motivated by circumstances of emergency or danger for himself or for others, any minor under 13 years of age in violation” with curfew rules “may be returned to his home by the internal security forces having noted this breach.”

In article 3, the decree specifies that“a call to order will be made” to minors and that “Parents will be notified of this”.

What about in the event of a recurrence?

In the event of a repeat offense, in accordance with the provisions of article R.610-5 of the penal code, breaches of the obligations laid down by the order “will be punished with the fine provided for 1st class contraventions”. The amount of the fine is 38 euros at most for 1st class contraventions.

Abandonment of minor

The decree adds that “if facts suggest that the abandonment of minors is possible, a report will be sent to the public prosecutor on the basis of theArticle 40 of the Code of Criminal Procedure.”

Such a curfew was already instituted in Nice from 2009 but was abandoned during the Covid epidemic in 2020. This new curfew in Nice is planned for two months. Not far away, in Cagnes-sur-Mer, a curfew for minors under 13 has been in force since 2004. A ban which, according to the municipality, “part of a global policy” including other measures for youth.

The towns of Béziers (Hérault), led by Robert Ménard, close to the far right, and Pennes-Mirabeau (Bouches-du-Rhône) adopted a similar measure last week. A curfew for minors is also in force in Pointe-à-Pitre, Guadeloupe, for a period of one month “renewable”.
