Vendée: a father accused of raping his wife every day to “check” that she is not cheating on him

The investigating chamber kept in detention, Friday April 26, 2024, a father accused of having raped his partner in La Roche-sur-Yon (Vendée) and Nantes (Loire-Atlantique) to “verify” that she wasn’t cheating on him.

The victim filed a complaint for the first time in June 2020 to denounce the “rapes” inflicted by the father of her children, with whom she lived “nine years” and with whom she was then “pregnant”.

Osama XXX was first referred to the Nantes criminal court for “violence” inflicted between September and December 2019: at the time, his partner had benefited from a “protection order” and had left to settle in Vendée.

But, during her second complaint, she said she was “ready to talk about the sexual violence” that the father of her children imposed on her: he had first made sure that she “stopped work”, he “made her was constantly watching” and wanted “to have a say in everything.”

“Regularly a finger in the vagina or anus”

For her part, she explained that she had “lost all desire for him”, but Osama XXX had imposed sexual relations “on several occasions” on the woman who “feared of being subjected to violence”.

She told investigators that her companion of 29 years he “regularly inserted a finger into the vagina or anus” to “check that she was not cheating on him”. Despite his protection order, prohibiting Oussama XXX from having contact with the young woman, he “came to see her” during her delivery, in La Roche-sur-Yon, “a month after” a new complaint.

But he still considers that “all their relationships were consensual”: they had “a wonderful relationship as a couple” even if he admits to having had “violent behavior” at the time when he “used drugs”. He also admitted to having “inspected” his vagina twice, while the victim mentions “daily checks”…

The expert responsible for ruling on the state of his ex-partner had for his part stressed that she had “no propensity to lie” and was now suffering from a “state ofanguish paroxysmal”.

Hit if it “did not position itself correctly”

Gradually, she revealed that the “sexual abuse” had started “early in the relationship”: her own mother knew that she “had to respond favorably to have peace of mind”. THE indicted could also “hit her when she did not position herself correctly during intercourse” and had also committed “violence against their eldest son”…

Osama XXX had however been raised by “his mother and his grandmother”, it was clarified, Thursday April 25, 2024, during the public hearing. This man, who was “at the RSA” at the time of his arrest in October 2022, was described as “vulnerable and fragile”, but also as “impulsive” and “intolerant of frustrations”.

He had also been convicted five times between 2012 and 2020, particularly for domestic violence on a former companion. But his lawyer considered that a house arrest under electronic surveillance (ARSE) was “sufficient” to prevent the risk of “pressure” on the victim and “prevent the renewal” of the offense.

The fact remains that, for the Advocate General, Osama XXX “never demonstrates questioning of his particularly dangerous behavior”: his “control” over his partner also gives rise to fears “that he will scare her and she will retract”.

He therefore requested that the person who wanted to “work in the social sector with young people” be kept in detention. The investigating chamber of the Rennes Court of Appeal finally agreed with his opinion.
