On Thursday, December 23, the courts rejected the request of the lawyers of Alain Ferrand, mayor of Barcarès in the Pyrénées-Orientales, reports “ici Roussillon” (formerly France Bleu). Indicted, Alain Ferrand still cannot go to the territory of his municipality. He will not be able to attend the ceremony of wishes to the population scheduled for January 31.
Alain Ferrand is notably indicted for “corruption by a public elected official”, “favoritism”, “illegal taking of interests”, “participation in a criminal association”, “money laundering” and “undeclared transfer of sums from the ‘stranger”. This indictment was issued as part of a judicial investigation concerning the management of public contracts relating to the municipality’s Christmas villages between 2012 and 2024.
After his examination on May 1, he was placed in pre-trial detention before being placed under judicial supervision. It was the investigating chamber of the JIRS (specialized interregional jurisdiction) of Marseille which rejected the request for relief from its judicial review filed by its lawyers.
Following this decision, Alain Ferrand decided to appeal to the Court of Cassation. “A judge does not have the right to prohibit an elected official from exercising his mandate!”estimates Me Jean-Robert Phung, the lawyer for the mayor of Barcarès.
