If Marvel and DC still dominate the superhero industry, they have both just lost the rights to the term after 45 years!

After 45 years this term becomes royalty free!

It’s official, the term superhero is no longer reserved just for Marvel and DC. So yes, as surprising as it may seem, the use of term “superhero” had been registered at the time by the two parent companies in 1979to prevent anyone from using it except them.

However, this all came to an end when DC embarked on a lawsuit against SJ Richold, author of the Superbabies comic series, for copyright infringement (as reported by Reuters). As a counterattack, the brand that owns Superbabies in turn attacked DC and Marvel, declaring that the two giants cannot claim an entire genre. Finally, the US patent office revokes the trademark rights of Marvel and DC.

News that delights many people, including Superbabies’ lawyer, Adam Alder, who said he was satisfied with this result for his client, but also for other artists who want to address this theme.

“Superhero stories teach us to defend the little ones. I hope this victory encourages small businesses to share their stories with the world.” – Adam Age

What does that change?

An announcement which also delights the series The boys who do not fail on account X (Twitter) to have fun with the situation:

Because indeed, works such as The Boys or My Hero Academia very little use the term “superhero” or almost none. Note that even at the time when DC and Marvel owned the rights, the situation was unclear. The term could be written in different ways. “Superhero,” or “superhero,” was often used in dialogue, but less so in titles. In short, a change which will not have too much impact on the big licenses talking about superheroes, but will now leave more room for those who want to try their luck in this field.
