For its franchised real estate agents the damage is done

Sarah Laassir is the guest of this new episode of My Real Estate Podcast. At the microphone of Ariane Artinian, the lawyer specializing in real estate and franchise contracts analyzes the consequences of the accusations of violence targeting Stéphane Plaza on the eponymous real estate agency network.

Created in 2015, the Stéphane Plaza Immobilier network has established itself as a benchmark in the sector thanks to the notoriety of its founder. But today, this visibility, once an asset, has turned into a weakness. “Franchisees are suffering an image crisis due to the direct association between their activity and the accusations against Stéphane Plaza. »explains Sarah Laassir.

On the ground, the consequences are concrete: agencies tagged with accusatory messages, mandates canceled by sellers, and even real estate negotiators who leave the network.

“Some franchisees report to me a loss of activity and difficulty convincing customers, because the Stéphane Plaza brand is directly impacted by this media crisis”continues the lawyer.

Leaving the network, a complicated solution

Faced with these difficulties, many franchisees are considering dissociating themselves from the brand.“Some people contact me to find out under what conditions they could remove this brand and join another network”confides Sarah Laassir. However, this option is not simple: franchise contracts often impose restrictive clauses, such as non-competition obligations or specific exit conditions.

What if collective action could be considered? The lawyer is categorical: “Under French law, group action is reserved for consumers. Franchisees, as independent traders, cannot use it. » The solution therefore lies in individual approaches, adapted to each contract and situation.

For Stéphane Plaza franchisees, the damage is done

While the legal verdict on the Stéphane Plaza affair is expected in mid-February, the impact on the network’s image already seems to be evident. “For some franchisees, the damage is done. Today, they face an unprecedented media crisis, and many cannot afford to wait for the legal outcome,” deplored Sarah Lassir.
