This is a provision of the Rist law, passed in May 2023, which will be implemented from Friday November 29, 2024. Announced by the Minister of Health at the 36e day of the National Order of Pharmacists, the publication in Official Journal of a decree this Thursday, November 28, extends from one to three months the possibility of exceptional renewal of medications in the context of chronic treatment. This measure, which was the subject of consultations with the pharmaceutical profession, also applies to medical devices.
For whom? Patients who are following chronic treatment (prescription lasting at least 3 months) whose interruption could be detrimental to their state of health.
For what duration? The exceptional renewal can be carried out within the limit of three months, by successive issues of one month. This therefore excludes the delivery of quarterly packaging. For month-by-month renewal, it is the most economical packaging that must be dispensed, while respecting the initial dosage.
Comment ? On the basis of a renewable prescription whose validity period has expired. The first exceptional renewal can only take place in the month following the expiry of the prescription. The pharmacist specifies the medicine(s) concerned as well as the number of boxes delivered by writing the words “exceptional additional dispensation” on the prescription next to the medicines concerned (with the possibility of checking an exceptional renewal in certain pharmacy software). This measure is also valid for medical devices prescribed for at least three months (venous compression items, blood glucose self-monitoring strips and lancets, etc.). The pharmacy stamp and the date of issue are affixed to the prescription if it is not an e-prescription.
What return to the doctor? The prescriber is informed as soon as possible of this exceptional renewal by secure messaging (or failing that by any other means guaranteeing the confidentiality of the information).
Exceptions? It is possible that a list of categories of medicines and medical devices excluded from the system will subsequently be the subject of a ministerial decree. From now on, medications are excluded from the system due to a maximum prescription duration of less than three months: narcotic, hypnotic and anxiolytic medications, tianeptine (Stablon), dipotassium clorazepate 20 mg (Tranxene 20 mg).
What support? Under the usual reimbursement conditions. A medication or medical device is covered beyond the validity date of a prior agreement or prior agreement when this is the case.
