An executive decree has just modified the modalities for establishing the premarital medical certificatean essential stopover to celebrate a wedding in Algeria.
Published in Official Journal No. 76this new legislative text aims to specify the conditions for establishing the medical certificate as well as the list of examinations and analyzes to be carried out before marriage.
“The purpose of this decree is to determine the procedures for establishing the medical certificate and the list of examinations and analyzes required before marriage, in accordance with the provisions of article 7 bis of law no. 84-11 of June 9, 1984, amended and supplemented,” announces article no. 1.
The main objective of this reform is to allow future spouses to assess their respective state of health and detect possible communicable diseases that can be passed on to their partner or future children.
This early detection also allows to identify diseases or the risk factors likely to pose a problem during a possible pregnancy. Finally, this measure aims to raise awareness among future spouses of the importance of a healthy lifestyle and family planning.
In accordance with the provisions of this new decree, a compulsory medical examination must be carried out by a general practitioner with each of the future spouses. At the end of this examination, a medical consultation is organized and each future spouse is given a prenuptial medical certificate, the model of which is annexed to the decree.
This certificate certifies that the future spouses have undergone the examinations and analyzes provided for by the regulations in force. It must be signed by doctor et hand-delivered to each of the future spouses.

The doctor is required to explain in a manner clear and individual to each future spouse the results of the examinations, the recommendations and the implications for their future health.
Marriage in Algeria: What are the obligatory examinations and analyses?
L’article 5 of the decree stipulates that the medical certificate can only be established by the doctor after having taken note of the results of the following examinations and analyses:
1- Exams:
- a careful interview looking for family or personal history, chronic pathologies, hereditary diseases or malformations, in particular chromosomal anomalies, genetic diseases and congenital heart defects;
- Measuring blood pressure;
- Measurement of weight and height;
- A complete clinical examination;
2- Analyses :
- A-Mandatory biological examinations:
- Determination of blood group (A, B, 0, Rhesus)
- Serological examinations for toxoplasmosis, rubella and syphilis.
- B-Recommended biological examinations:
- Viral hepatitis B (HBV) serology;
- Viral hepatitis C (HCV) serology;
- Human immunodeficiency virus (HIV) serology
The doctor can, if necessary, prescribe other complementary biological analyzes in case of suspicion of sexually transmitted diseases.
It is also recommended to check the health record to assess vaccination status against tetanus, tuberculosis, poliomyelitis, measles, rubella, mumps and whooping cough.
The new decree requires the civil registrar to refuse to establish the marriage certificate if the future spouses do not present a medical certificate dated less than three months ago.

This executive decree stipulates in its article 6 that “the notary or the civil status officer cannot proceed to the establishment of the marriage certificate only after presentationby each of the future spouses, of the prenuptial medical certificate, dated less than three (3) months.”
However, article 7 of the decree specifies that the notary or civil registrar cannot refuse the conclusion of the marriage for medical reasons, against the wishes of the parties concerned.
