The creation of family courts in Valais is on track. The Valais Grand Council accepted a motion along these lines on Wednesday by 89 votes to 39 and 1 abstention.

This motion “proposes the creation of specialized courts competent to rule on all cases relating to family law. These would be attached to the courts of first instance,” explains centrist mover Kamy May. The objective is “to unify all family matters under the same jurisdiction, thus guaranteeing fair, uniform and rapid treatment”.

Currently, children are not all in the same boat. Depending on the marital status of both parents (single, married or divorced), the case will not be handled by the same authority. While some will be judged by judicial authorities (in this case by district courts), others will be dealt with by child and adult protection authorities (APEA), which are administrative authorities subject to to the Council of State.

This cohabitation initially seemed to go smoothly, but over time society became increasingly judicialized (increasing presence of lawyers at early stages of the procedure) and cases became increasingly complex. , so much so that many APEAs found themselves overwhelmed, says the motion. A simplified organization would also avoid “overly long and costly procedures” which affect the family and children, adds Kamy May.

“The need is clear”

Part of the PLR ​​considered it “premature to accept the text as proposed” and would have liked its transformation into a postulate. “All professionals in the sector are currently working to redesign the entire Valais judicial system, let’s give them time to make a global proposal,” argued the training.

This proposal is not rushed, replied Kamy May in substance: “The need is clear and the solutions are ripe. The Constituent had already carried out an in-depth analysis on the subject by meeting with professionals on numerous occasions”. These courts were notably part of the draft Constitution which was refused by the Valais population last March.
