A magistrate of detentions and liberties of the Judicial Pole therefore gave his agreement this Tuesday, the day after a recommendation from the prosecution to the same effect.

Towards a dismissal?

Regarding the consequences of this case, the Argentine justice system must now decide on the request for dismissal filed on Tuesday, August 27 by the lawyers of the two rugby players. But The date for examining this request has not yet been set.In the event of a dismissal, the proceedings against the Pau and La Rochelle residents would be “definitively and irrevocably” closed according to the terms of the Argentine Penal Code.

The plaintiff’s lawyers have indicated that they will formally oppose the dismissal of the case. They also filed, on Monday, September 2, a request for disqualification of the prosecutors in charge of the investigation pour “mental violence and lack of objectivity” which the Mendoza public prosecutor rejected for lack of evidence. The French lawyer of the two rugby players, Antoine Vey, had denounced “yet another delaying tactic, (which) does not change the phase of the case in any way.”

The prosecution has requested a return to France with “rules”

Until the Argentine justice system has ruled against the charges, Oscar Jégou and Hugo Auradou remain charged with aggravated rape, because they were in a group. The complainant, a 39-year-old woman, claims to have been raped and assaulted by the two 21-year-old internationals on the night of July 6 to 7, in a hotel room in Mendoza, on the sidelines of a tour of the Blues in South America. The Pau native and the Rochelais man admit to having consensual sexual relations, but deny any violence.

The spokesperson for the Mendoza provincial justice system specified on Monday, September 2, that the green light given by the public prosecutor’s office for the return to France of the two rugby players was “accompanied by rules”. Oscar Jégou and Hugo Auradou must in particular present themselves if summoned to the Argentine consulate in Franceestablish a real and virtual address”or even “to report to Mendoza (1,000 kilometers from Buenos Aires) if requested”.

Arrested on July 8 in Buenos Aires, Oscar Jégou and Hugo Auradou were placed under house arrest on July 17, before being released by decision of the Mendoza prosecutor’s officebut with a ban on leaving Argentina during the investigation. In ordering the release of the two players, the prosecution had noted “notorious contradictions, inconsistencies, gray areas” in the version of the complainant who attempted suicide on August 23. She has since been hospitalized. On Tuesday, August 27, the Rochelais and the Pauois were able to recover their passports and leave Mendoza, where they had been since the beginning of July, for the capital Buenos Aires, and an unknown place of residence.
