In a decision published this Friday, September 13, the Constitutional Council has declared Senator Annick Girardin ineligible for one year. According to the Sages, the elected official had not opened a campaign account, which is mandatory.

The Sages have decided: Annick Girardin, senator for Saint-Pierre-et-Miquelon and former minister under the mandates of François Hollande and Emmanuel Macron, will be ineligible for one year. This Friday, September 13, the Constitutional Council published its decision concerning the elected official on its website. On February 26, 2024, the institution had been contacted by the National Commission for Campaign Accounts and Political Financing regarding Annick Girardin’s campaign account, in the context of her election on September 24, 2023.

Elected in the first round with 51.3% of the vote, Annick Girardin should have submitted her campaign account to the National Commission for Campaign Accounts. However, the latter rejected it due to the lack of bank statements attesting to the existence of such an account and proof of its opening. In other words, Annick Girardin did not open a campaign account. As a reminder, the law provides that an elected official “is required to establish a campaign account when he has obtained at least 1% of the votes cast or if he has benefited from donations from individuals”.

Annick Girardin loses her mandate as senator

In her defense, Annick Girardin argued: “the particularity of the senatorial election in Saint-Pierre-et-Miquelon”His financial agent had opened a bank account on March 21, outside the deadline requested by the National Campaign Accounts Commission, “at the latest before 6 p.m. on the tenth Friday following the first round of voting”. Annick Girardin is therefore ineligible for one year, but also “declared to have automatically resigned from her mandate as senator” by the Sages. According to the HuffPost, Annick Girardin’s two other competitors in the senatorial elections, Jacqueline Cormier-André (Archipel demain) and Patrick Lebailly (Ensemble pour Construire) are also in the hot seat for the same reasons, and will soon know the decision of the Constitutional Council.
