89 advisors instead of 104
For its solemn hearing, Wednesday January 22, 2025, the industrial tribunal took stock of its year 2024. Eleven advisors were recruited “but that does not compensate for the resignations since the start of the mandate. Last year, twelve councilors resigned »indicates Philippe Peniello, vice-president. While the council could have 104 industrial tribunal advisors, there are only 89.
At the same time, activity increased by 14% (from 723 referrals in 2023 to 826 in 2024) and in all sections, “which is quite rare”he notes. While trade remains the most important, agriculture has seen a 300% jump, with an increase from seven to thirty referrals in 2024. “We will have to see if it is anecdotal or linked to the agricultural crisis”he continues.
Referrals for summary proceedings fell by 6%, conciliations by 10%. “The latter are the primary vocation of our jurisdiction. Ways have been mentioned to improve this rate because this drop alerts us”says Philippe Peniello, before immediately greeting the “very low recourse to the deciding judge, 2% which demonstrates the desire of the advisors to render a decision”.
-Eighteen months on average to process files
The number of completed cases is increasing (+7%), as is the average processing time, at 18.3 months. A time “too long for the litigant” according to the vice president. The appeal rate, of around 40%, is lower than the national average (60%). Concerns include the large number of files, the resources allocated to advisors and finally the structure of the registry.

We are not professional magistrates and your presence is essential to us”finally greets Martin Bourgoin, who takes his place in the president's chair with “modesty and humility, with the desire to take an interest in the human and material issues of our council”.
