This is the end of a long fight for the six employees of a bakery in La Roche-sur-Yon.
The latter had found themselves without work and without pay since last September, their boss having vanished into thin air.
On December 4, 2024, the commercial court of La Roche-sur-Yon pronounced the judicial liquidation of the businessputting end to more than four months of anguish for Anne, Jenny, Jessica, Van, Gwendoline and Nina.
“A happy outcome on the eve of the holidays,” rejoices Pierrick Chaigne, FO representative who supported and led the fight alongside these employees.
Closed door and more salaries
A little reminder of the facts.
Last September, employees of the bakery Le Moulin de La Roche 2, located a stone's throw from the Pentagon in La Roche-sur-Yon, found themselves in front of the closed door of their workplace.
With a boss with absent subscribers who no longer answered any phone calls.
Deprived of workthe six employees also found themselves deprived of salary. And without the possibility of turning around or leaving for another job, because still under contract with the bakery.
Pierrick Chaigne, FO delegate, heard of their story and decided to help them. By knocking on all the doors to get them out of this slump.
Handrail, complaint filing and press articles. We knocked everywhere we could to solve this unprecedented affair. In 25 years, I have never had a case like this.
Liquidation at the request of employees
The former manager, a young 21-year-old baker who took over the franchise at the end of 2023, remained nowhere to be found. Even his parents didn't know where he was. On the advice of a lawyer from La Roche-sur-Yon, it was ultimately the employees themselves who put together a file to request the judicial liquidation of the bakery from the commercial court.
“Aware of their situation, the court was very understandable, very attentive,” notes Pierrick Chaigne who praises the speed of processing of this case which finally resulted in a few days of Christmas.
“Upon liquidation, employees were able to receive three months’ salary. The fourth was instantly transferred to them on December 17. This liquidation also notifies their dismissal for economic reasons, which gives employees the right to a professional security contract (CSP) which will provide them with compensation for one year up to 75% of their gross salary and the possibility of applying for a other job or training,” explains the employee advisor.
The procedure is not yet over.
“In particular, it remains to be resolved the case of an employee who had had a work accident during her contract, but who had not been able to benefit from occupational medicine, the boss not being in order with her contribution payments “.
Not to mention a procedure brought by the City of La Roche, since the boss also had a bench at the Les Halles market.
Marked employees
This story has a happy ending, but will however leave traces among employees.
“Two say they are ready to leave with a serious buyer of the bakery, but the others were particularly impressed. Some have been weakened and must above all regain their health and others are considering retraining,” concludes Pierrick Chaigne. A new stage which nevertheless promises to be more serene with this happy outcome.
