After years of litigation, the federal government reached an out-of-court agreement aimed at compensating non-unionized or casual federal civil servants, victims of pay problems caused by the Phoenix system.
The law firm Saraïlis Avocats made the announcement on Wednesday, indicating that thousands of non-union or casual federal employees who worked for the government between February 2016 and March 2020 can obtain individual payments.
It all started with the class action brought in 2017 by Ezmie Bouchard to obtain compensation after moral damages suffered by employees affected by the fiasco of the Phénix pay system which had affected thousands of civil servants.
“The negotiations led to an honest and fair agreement for the members of the collective action in order to compensate for the moral damage suffered due to these difficulties,” explained Me Christian Saraïlis in a press release, without revealing the overall amount of this settlement.
The agreement provides for individual payments for class members based on the number of eligible years they have worked, the firm said, adding that the agreement will be subject to approval by the Superior Court of Quebec on February 18.
