Quebec obtains an interim injunction to stop illegal dumping in Kanesatake

The Quebec government obtained a provisional interlocutory injunction from the Superior Court on Monday to stop the illegal dumping of soil in Kanesatake.

This injunction orders the people responsible for these lands and soil deposits to immediately cease the addition of soil and backfilling operations on the shore and coastline of Lac des Deux Montagnes.

Towards the end of last August, field surveys and the taking of samples were carried out in the targeted territory as part of a criminal investigation by teams from the Ministry of the Environment, the Fight against Change Climate, Wildlife and Parks (MELCCFP).

This operation revealed the presence of contaminated soil among the embankments present on the coast of Lac des Deux Montagnes.

It also confirmed the sole presence of embankments in the shore and the coastline of the lake representing a risk for the quality of the water and wildlife habitats.

Due to its results, the Attorney General of Quebec obtained a provisional injunction to immediately stop illegal dumping on the shore and coastline of Lac des Deux Montagnes.

Illegal deposits may be subject to various coercive measures depending on the degree of seriousness of the violation, in particular criminal fines which may vary from $10,000 to $1,000,000 (natural person) and from $30,000 to $6,000,000 ( legal entity).

To complete this operation, the MELCCFP works closely with several partners, including the Kanesatake band council, the Sûreté du Québec and the Secretariat for Relations with First Nations and Inuit.
