After 39 years of marriage, Guido* broke Antonia*’s heart by leaving her for his mistress. “For me, it was a nightmare. (…) The end of our union was a big trauma. He dumped me for another woman and left the house overnight,” explains to Restaurant del Carlino the 59-year-old Italian, stay-at-home mother near Rimini (north-east). A misfortune never comes alone, the 61-year-old man came to live with his new partner… a few hundred meters from the marital home.

In addition, since last August, Guido no longer pays the alimony rightfully due to Antonia. “He stopped paying me money to pay the house mortgage,” says the fifty-year-old, who lives in the same building as one of the two children she shares with her ex-husband. Both are now adults and economically independent.

At her wit’s end, Antonia sought the services of a lawyer and attacked Guido for non-payment and moral damage. Antonia indeed affirms that the behavior of her former partner plunged her into “a strong depression”. On Tuesday, a court ruled in favor of the complainant: her ex-husband agreed to pay her alimony of 350 euros, plus arrears, as well as the sum of 4,300 euros for moral damage.

“This is not the first separation case in which moral wrongs have been recognized. But this is a really special case, given that the man had moved in with his new partner right next to his ex-wife,” notes Elena Guidi, Antonia’s lawyer. The fifty-year-old did not expect to win her case: “She was not only my lawyer, but also a friend. All women need professionals like her,” marvels the Italian.
