On appeal, the Düsseldorf court dismissed an employee’s complaint for unfair dismissal. Faced with the employee who did not like the red color of his work pants, the court considered that this clothing was necessary for reasons of safety at work.

Fired for wearing the wrong color work pants. This is the mishap that happened to an operator of an assembly line of an industrial company in the region of North Rhine-Westphalia, in western Germany.

A dismissal which followed several warnings, since the employee was a repeat offender of wearing pants of the wrong color. He was fired in November 2023 for this reason and filed a complaint for unfair dismissal according to the German daily Bild.

According to the Spiegel article, the editor argued in his defense that he did not like red pants.

Work in a risk area

The decision rendered by the Düsseldorf state court on appeal on May 21 confirms that rendered at first instance by the Solingen court.

“The employer was entitled to impose red as the color for protective pants at work,” considered the regional court.

Beyond the anecdote, one of the explanations for the decision lies in the fact that the color red contributes to safety at work by improving the visibility of the employee. The man worked in risk areas where employees and forklifts meet. In other production areas without machines, “red is a signaling color” increasing everyone’s visibility and thus contributing to safety at work. Secondarily, it was also a way to standardize work clothing and contribute to the company’s visual identity.

The aesthetic considerations of the dismissed employee were therefore irrelevant, especially since the complainant had worn the requested work clothing since 2014, the date he took up his position in the company.
