Misled by false data concerning their retirement date, France Travail paid allowances to people who should have been retired. Amounts that the organization now wants to recover.

Retirees faced with a real micmac involving France Travail and pension funds. The France Travail mediator, Jean-Louis Walter, reports in his annual report an unusual dysfunction, which has left certain beneficiaries heavily in debt.

“The amounts claimed commonly reach tens of thousands of euros,” according to this report.

In question, the transmission to Pole Emploi (former name of France Travail) of erroneous data, coming from the Retirement and Occupational Health Insurance Fund (Carsat). Data relating to workers’ careers, including a forecast date for full retirement. For job seekers, these dates allowed Pole Emploi to calculate the date on which the retirement pension would replace unemployment insurance.

Alas, the Pole Emploi agencies did not require an official certificate but a simple career record at a given moment: a career record for which information could be missing, and which therefore indicated an incorrect retirement date.

As a result, job seekers were compensated for their unemployment for too long – for periods when they should have received their pension – and France Travail noticed this too late, by not cross-checking the official Carsat data once the person who has retired.

Processing times too long

France Travail is therefore demanding reimbursement of these overpayments, estimated between 5,000 and 100,000 euros per person by Jean-Louis Walter. But if it can legitimately claim these sums unduly paid, the beneficiaries have not received the retirement pensions they replaced. And the payment of pensions is not retroactive: the people concerned therefore have no way of compensating the sums they are asked to repay.

The France Travail mediator is therefore the subject of numerous complaints, and “requests for mediation overpayments gradually extended to all regions, many of them being brought by the Delegates of the Defender of Rights”. He nevertheless recalls that decisions remain subject to the regional joint authorities responsible for awarding allowances and pensions. He therefore sent a warning note last August to request rapid treatment of the problem by Pôle Emploi, Cnav (National Old Age Insurance Fund) and Unedic.
