Big conflict around a commission: this real estate broker tried to use the credit card of his colleague


A Montreal real estate broker attempted to transfer more than $ 6,000 to his bank account with his colleague’s credit card, while they were in conflict about the sharing of a commission on the sale of a house.

Jason Mossa recognized his guilt last month in front of the Quebec Real estate brokerage self -regulation (Oaciq). He received a fine of $ 2,000 and a suspension of 60 days.

He confessed to having tried twice to levy $ 6,669 from his partner’s credit card in September 2020.

At the time, the broker worked as an administrative assistant to a Re/Max agent in the Montreal region, Lise Pigeon, for a little over a year. Mme Pigeon and Mr. Mossa had an agreement to share compensation.

A relationship that turns vinegar

In the weeks preceding the event, the relationship between the two brokers, however, has been pointed out, to the point that they decided to end their collaboration.

During this period, the duo concluded a transaction whose buyer was a close friend of Jason Mossa. According to the version of the broker’s facts, Mme Pigeon and he would have agreed verbally so that Mr. Mossa retains all of the retribution on this sale.

However, in accordance with the collaboration agreement they had signed, Mme Pigeon has kept 40% of the remuneration on this transaction.

“It is therefore on this premise that the respondent has devolved the right to take sums from the credit card [sa collègue]and this, without its authorization, ”reads the decision of the Oaciq.

“Lack of probity”

To justify the sanction imposed on Mr. Mossa, the disciplinary committee insists on the “lack of probity and integrity” which he showed in this case.

“The aggravating objective factors are the almost criminal or fraudulent nature of the acts posed […]the conscious will for the respondent to transgress the rule, the attempt to appropriate the sum, the repetition of the attempt and the breach of confidence in the broom [Lise Pigeon]”, Is it explained in the decision.
