The man faced seven counts and was found guilty for all of them with the exception of that of attempted murder, which was however crucial for the prosecution.
The judge was not convinced beyond all reasonable doubts that the accused wanted to kill the SPVM agent, since he only drew once in his direction.
“It was a steep slope to cross for the prosecution,” said the prosecutor on the file, Me Charles Côté. “We must demonstrate the intention to kill the accused. Unless specifically telling his victim when he commits the gesture, it is almost impossible to prove. ”
However, the prosecution said that it expected this conclusion.
Reminder of the facts
On July 13, 2022, a police duo went to the intersection of Saint-Mathieu and Saint-Catherine after being informed that a man moves with a firearm. The police quickly locate and identify Heptbourne, who is actively sought in Ontario for various violent crimes.
It is when the police order heptbourne to let go of his weapon that he fled, shirtless. Many surveillance cameras capture the intense pursuit which takes place for almost thirty minutes. It is in an alley that the accused opens the fire to the police.
A bullet reaches one of the police officers on the leg.
Shortly after Heptbourne took over, he accidentally pulled himself in the leg and injured himself.
The fugitive tries in vain to enter an apartment in order to hide there. Heptbourne ends up hiding under the balcony of a citizen for several minutes.
He then decides to leave and throws his weapon in a bush and is finally controlled by many police officers at the exit of an alley.
