At the beginning of September, a TEMU delegation from Ireland had to go to Bern, under the convocation of the State Secretariat for the Economy (SECO). According to information available at the time, civil servants “explained the requirements of unfair competition law” to representatives of the Chinese online commerce giant. During the following months, an “exchange” took place, notably in the SECO premises in the Bernese district of Weissenbühl, as the Federal Office announced on Thursday. Thus, several changes have therefore been made at TEMU:
- In the event of discounts or price comparisons, it should now be noted that the barred reference price corresponds well to the price of the TEMU product which was valid immediately before the price drop.
- The names, address and email address of the sellers are now indicated.
- The game “turns the wheel”, which consists in providing kinds of advantages to users, has been abandoned.
- The mention “almost exhausted” can now be used only if the remaining stock is between 20 and 99 units, and could therefore be exhausted in a few days. Previously, the mention “almost exhausted” was much wider, and used for stocks of up to 199 units. A control system must guarantee the appropriate use of this mention.
- Various mentions which put the customers of TEMU under pressure were deleted. For example, these are sentences such as “hurry up!” More x people added this article to their basket! ”. Other mentions, such as “Lightning Offer”, have been reduced.
- Various mentions appearing in the marketing emails that put TEMU customers under emotional and temporal pressure have been deleted. This means that sentences including “we regret to inform you”, “hurry up, otherwise you will miss something” or “you must act, otherwise your favorite article will be exhausted” should no longer appear in the future.
The European Branch of TEMU, Whaleco, based in Ireland, “is committed to maintaining these changes,” said Seco. In return, the Office renounces any “legal action” against Whaleco. However, the Seco warns:
“In the event of new complaints concerning the loyalty of the offer, the State Secretariat will remind Whaleco to its obligations.”
Temu, who had so far been rather discreet, also spoke on Thursday. A company spokesperson said:
The adjustments would reflect “the constructive approach of TEMU in its cooperation with the authorities”. TEMU also undertakes to maintain its “strict standards” in terms of consumer protection.
