A complaint targeting three ministers was filed Thursday April 10 before the Court of Justice of the Republic, reveals, Monday, April 14, France Inter exclusively with the newspaper The world. The complainants denounce the harassment they suffer within the hospital for some, the suicide of their close caregiver for others. Twenty complainants gathered to file this complaint before the Court of Justice of the Republic, the only body capable of judging ministers for acts committed in the exercise of their functions.
This complaint for “moral harassment, deadly violence, manslaughter, and jeopardy of the person”, was filed Thursday, April 10. She aims Catherine Vautrin, Minister of Labor, Health and Solidarity, Yannick Neuder, Minister of Health and Access to Care, and Élisabeth Borne, Minister of National Education, but also higher education and research. It is also in charge of teaching medicine and has a disciplinary authority on professors of hospital practitioners (PU-PH).
The files that feed this complaint come from nurses, hospitals or even the very prestigious category of professors from hospital practitioners (PU-PH). Some files are carried by beneficiaries, because there have been several cases of suicides. In particular a nurse from the Béziers hospital center who ended her days in June 2024, leaving a letter behind her, as Sam, her husband tells. “She made this gesture to protect other nurses, he testifies. She was faced with an unbalanced schedule, an overload of work.“Besides, this nurse “felt harassed by his head of service too”continues her husband. Three months later, in the same hospital, a stretcher bearer ended his days. Another case: that of a chief of the emergency room of the hospital group of territories (GHT) of the Yvelines Nord, died in September 2023, or that of an EPSAN labor nurse, the public health establishment Alsace North of Brumath in the Bas-Rhin, who hung in January 2023.
Christelle Mazza, the lawyer who files this complaint, denounces the consequences of hospital management. It evokes systemic moral harassment and is based on three principles. “First there is the organization of institutional disorganization, with ministers that change all the time, multiple hospital reforms”she explains. “We have such chaos that agents no longer know who to account for, and this dilutes responsibilities. There is also the alleged doxa of budgetary constraints where we say that we will have to do more with less”regrets Christelle Mazza. “And then there is obviously the pressure exerted on staff, we crush any form of dissent. And the system only works on their dedication, respect for the patient and the hippocratic oath, but where the state is considerably responsible, it is to instrumentalize this dedication to crush and use the personnel”denounces the lawyer.
To have a chance to succeed, the complaint must pass a first filter to the Court of Justice of the Republic, that of the request commission. She will study the complaint on June 19 to determine if she goes to instruction or is not going further. This commission’s response is expected in the fall.
