Confirmed convictions for murder in Cervinara

The judges of the Supreme Court confirmed the sentence of conviction to 16 years for Alessio Maglione and at 10 years and 8 months for Giuseppe Moscatielo. For the two, accused of the bullet murder of the quadragenaire of Cervinara, Nicola Zeppetelli in front of the private circle, the doors of the prison will soon open. Convictions become final despite the fact that the prosecutor general of the Supreme Court and the defenders of the two accused invoked the cancellation of the second degree sentence issued in October 2024. On appeal, the judges had reformed the sentence only for Moscatielo from 12 years to 10 years and 8 months of imprisonment, while for Maglione, the conviction to 16 years had been confirmed. The murder of Nicola Zeppetelli took place on February 19, 2022 in Cervinara, in front of the private circle managed by the victim. Alessio Maglione was considered the material executor of the crime, because it was he who fired the shots, four in all, against Nicola Zeppetelli. Alessio Maglione has always argued that “everything would have started from an argument shortly before between himself and the victim’s brother. After the dispute, Maglione would have gone to Nicola Zeppetelli to clarify the situation and find a solution. ” Elements on which the lawyers of the civil parties have always insisted a lot, believing that the version provided by the accused was not truthful. The survey was initially entrusted to the antimafia management of Naples, but the investigation activity highlighted that it was not a mafia execution. Circumstances which had already emerged during the interrogation of guarantee, because the accused Alessio Maglione admitted to having shot on Zeppetelli after a strong argument. Moscowielo, for his part, did not denote his presence on the crime scene, adding that he had played the role of accompanist of Maglione, but being ignorant of everything, both true intentions of his friend and because he was armed. Meanwhile, in November 2023, house arrests were granted to Alessio Maglione. The investigating judge of the Naples court then also accepted the request for attenuation of the detention measure presented by his lawyer, Giulia Cavaiuolo. While in March 2024, the Naples review Court accepted the advocated request by lawyer Luigi Petrillo, ordering the release of Giuseppe Moscatielo and granting the household assignments initially outside the Campania region. Lawyer Luigi Petrillo, defender of one of the accused sentenced in the third degree, specifies “there is strong doubts about the real murderous desire of the accused, as it is true that today the Attorney General at the Court of Cassation asked for the cancellation of the sentence. The lawyers of the civil parties, Vittorio Fucci, Rolando Iorio and Marianna Febbraro, during the discussions, asked for confirmation of the convictions.
