
It is common to note that public inquiries are little mobilizing the population. The one that was organized for five weeks on the project of modification n ° 5 of the local urban plan (PLU) is an exception to the rule. “”The public came very numerous and, as soon as each permanence opened, several people were already waiting to be received “, Indicates in his report the investigating commissioner in charge of the file. He even specifies having had to “open three new registers” In order to allow the public to note its contributions.
In the end, 89 observations were registered in the registersto which are added 18 letters and documents handed over to the investigating commissioner, as well as 105 emails and postal mail. Of these contributions, it appears that “Concerns have been expressed in terms of the densification of constructions, the height of buildings, infrastructure linked to the increase in population, parking and soft mobility, as well as environmental aspects, particularly in terms of green spaces and the fight against excessive soil artificialization”.
The merits of the OAP
After examining the project, the investigating commissioner decides on the bottom of the file in which six new development and programming orientations*are presented. For the record, these OAPs aim to identify the possibilities of landscaping and urban developments on the scale of the district. They make it possible to cap the number of housing in sectors where the current PLU regulations allow more to do more, while imposing a type of development on promoters. In his conclusions, the investigating commissioner therefore considers that “The objective of supervising the composition of the frame and open spaces in the form of islets is virtuous because it allows to fight against chaotic urbanization“. He believes that “The limitation of densification compared to the current PLU is a relevant choice with regard to the fight against excessive artificialization of the soil, and which meets the expectations expressed during the public inquiry”. However, adds the investigating commissioner, this objective “will only be really affected with the firm desire to authorize the construction of a reasonable number of housing in each OAP, and to guarantee a coverage of green spaces with varieties chosen to provide real islets of greenery and biodiversity”.
A series of recommendations
In continuity, the investigating commissioner makes a series of recommendations. Among others: “Conduct preliminary studies to verify the absence of aggravation of the flood risk due to the future constructions provided for in the OAP Moneiret – June”.
Concerning l’OAP Zola – Vernehe recommends“Study the possibility of not demolishing the house located at 32 avenue Emile-Zola so as not to infringe excessive property law if there is an alternative”.
-About the risk of marine submersion, the investigating commissioner underlines that “Taking into account the decline in the coastline is a major issue that requires studies without further delay in order to adapt the guidelines and projects for upcoming constructions”. He also asks for “Complete if necessary the provisions already inscribed in the PLU regulation about the risk of flood”.
Finally, he suggests to the community of“Consider an answer with regard to the request for” hard “facilities for the rowing club”. In the end, the investigating commissioner therefore issues “an unreservedly favorable opinion” to the project to modify the PLU. From now on, the Metropolitan Council will have to deliberate to approve the project which may be modified to take into account the opinions which have been attached to the file and the result of the public inquiry.

A tackle to the mayor
In his report, the investigating commissioner formulates a “observation” concerning the mayor of La Seyne who, he notes, “Expressed itself in an article published in Var-Matin on March 5 and on the city site on March 10, in which it affirms for example, about Coste Chaude,” we go to the agricultural zone and we will install a farmer “. Hence this observation: “The mayor decides by affirmations on modifications which are only in the state of projects, in the midst of the public inquiry, and therefore without waiting for the conclusions of the investigating commissioner and the deliberation of the metropolitan council which will decide on the approval of modification n ° 5 of the PLU, possibly modified”.
